RELEASE AND WAIVER OF LIABILITY
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY, AND CONSTITUTES A CONTRACT BETWEEN ME AND Leymi Gutierrez Photography.
The Instructors are not responsible for any personal injury or damage to property arising from incidents occurring at the shootout venue.
Please be aware of where you keep your belongings at the shootout and please remember to check your equipment at the end of the shootout so you do not leave anything behind. We are not responsible for loos of, or damage to, your personal property.
You are responsible for any damage to the venue, props or clothing that may become damaged in your care. Please be conscious with posing and location within the venue when photographing each model.
Terms and Conditions Agreement
The terms and conditions form the agreement between you and The Instructors. By booking a shootout and signing this agreement, you agree to abide and be bound by these terms and conditions. If you have any questions or concerns about this agreement, please contact info@leymigutierrez.com
1.0 In order to get the most out of the shootout, you should ensure that you arrive on time. If you are unable to attend you must notify us by email at info@leymigutierrez.com. Late comers are admitted only at the discretion of The Instructors. You are not entitled to a refund if, because of your lateness, you miss all or a portion of the shootout.
1.1 If behavior or conduct is deemed unacceptable or inappropriate, you will be asked to leave the shootout. No refund of fees will be made.
1.2 The Instructors are entitled to change the venue or make changes to the structure of the shootout. In the unlikely event that changes are made there will be notice made to all attendees as soon as possible.
2 Fees & Cancelations
2.1 You must pay half the amount for each shootout at the time you enroll. The amount of the shootout fee will be specified at the time you complete your enrollment. The Shootout fee confirms your spot on the shootout. The remaining balance is due 14 days before the event.
2.2 Following acceptance of your booking, you must pay the full amount of the shootout fee at least 14 days before the course start date. Failure to pay the remainder of the fee will result in your losing place in the shootout and you will not receive a refund of any portion of your retainer.
2.3 If fees are not paid by the due date, The Instructors will be entitled to reallocate your place. You shall remain liable for the remainder of the fee for the shootout if we are not able to fill your place in the shootout.
2.4 PayPal & Bank Fees - If you cancel your place on the shootout and there are Paypal/bank fees to process the refund of your booking transaction, you will be responsible for those fees and this amount will be removed from the total of your refund.
2.5 The Instructors may cancel a shootout at any time prior to commencement. In the unlikely event that we cancel a shootout The Instructors will notify you as soon as possible and any fees or deposits received from you will be refunded. Please note that The Instructors will not refund travel or accommodation costs for cancelled shootouts.
2.6 Elements of each shootout (e.g.: venue, models, speakers, etc.) may be subject to change without notice. No refunds will be given in the event of any such changes although we will endeavor to notify you, if possible, of the changes.
Image Usage & Privacy
3.1 Attendees are not permitted to use images taken at the shootout for commercial purposes. Image usage is strictly portfolio use only (website and online). Social media usage is allowed but only to showcase your portfolio. Images must not be submitted to magazines, exhibitions or competitions without permission. You may use images for marketing your brand and business or for personal use.
3.2 You acknowledge that we have advised you that none of the participants in the shootout have given releases allowing commercial use of any images taken at the shootout and that you may be subject to legal liability if you use any images commercially. We request that you submit 1 image of each model to Instructors to be given to models for personal use. A shared drop box folder will be created for you to do so. Attendees must credit Leymi Gutierrez when posting images on social media.
5 General
The contract contains all of the terms agreed between you and The Instructors and supersedes any discussions or other information previously provided concerning the shootouts.
